Terms of Service

Service Policy | Product Description and Terms of Use

Thank you for your interest in Boywithgirl—a design brand dedicated to handcrafted clay home décor pieces. We believe that every handmade object is the result of a dialogue between natural materials and human fingertips, a warm footnote in an otherwise industrialized age. Before you browse, purchase, or use our works, we sincerely recommend that you read the following Service Policy carefully. It covers the fundamental agreements between you and us regarding product characteristics, usage guidelines, intellectual property rights, and legal responsibilities. Our goal is to protect the rights of both parties, ensuring that every encounter with the beauty of handcrafted art is clear, reassuring, and enjoyable.

I. About Us and Our Operating Entity

Boywithgirl is a handmade design brand wholly owned and operated by HONGKONG KATE LIMITED. As the parent company and global operational entity of the brand, Hong Kong Kate Limited is fully responsible for the design development, handmade production, quality control, global warehousing and logistics, and customer service system of all Boywithgirl products. Our brand's creative and operational center is located at UNIT E01 10/F WONG KING1 INDUSTRIAL BUILDING NO 2-4 TAI YAU STREET SAN PO KONG KL—a place where drawings meet clay, and where every piece is carefully packaged before embarking on its journey to destinations around the world.

II. Product Description and Handmade Characteristics

Our core product line is the Handmade Clay Funny Dog Vase series, along with various extended clay home décor pieces. Each work is hand-sculpted, refined, glazed, and high-temperature fired by experienced artisans.

Before making a purchase, we kindly ask that you fully understand and appreciate the following inherent characteristics of handmade ceramics:

1. Uniqueness and Non-Replicability
Each piece is independently crafted, so no two products are exactly alike. Even within the same style, different pieces may exhibit visible micro-variations in facial expressions, body postures, ear positions, tail curves, and more. These differences are not flaws but natural imprints of the handcrafting process—proof that each "little dog" possesses its own distinct personality.

2. Reasonable Variations in Size and Weight
Due to natural shrinkage during hand-shaping and firing, the final dimensions of the same style may vary within ±0.5 cm to ±1 cm, and weight may differ by approximately ±5%. The sizes and weights listed in our product detail pages are approximate reference values; the actual piece you receive may differ slightly.

3. Natural Variations in Glaze Color and Texture
Clay glazes undergo unpredictable chemical reactions at high temperatures, resulting in natural effects such as color gradation, flowing patterns, or crystallization. Even among pieces from the same batch, actual firing colors may vary slightly due to factors such as kiln position and firing temperature. These variations are part of the charm of ceramic art and do not constitute quality defects.

4. Visible Handmade Traces
The surface of each work may bear the artisan's fingerprints, minor scratches, clay seams, or tiny pinholes (commonly known as "pinholes" or "orange peel effect"). We conduct quality screening before shipment to ensure these traces do not affect overall aesthetic appeal or functional safety. However, for consumers who seek absolute "perfection," we must candidly state: handmade clay products cannot achieve the standardized precision of industrial mold-made goods. Please carefully assess your own tolerance before purchasing.

III. Terms of Use and User Responsibilities

1. Intended Use and Applicable Scenarios
Our products are primarily designed as indoor decorative vases and artistic ornaments. They are suitable for placement on dry, stable surfaces such as tabletops, shelves, or cabinets in living rooms, studies, bedrooms, or offices—for use with dried flowers, artificial flowers, or a small amount of fresh cut flowers (ensure the vase holds water without leakage, but we recommend filling water no more than two-thirds of the vase height). Please do not use these pieces as children's toys, kitchenware, tableware, outdoor garden containers, or load-bearing supports.

2. Care and Maintenance Guidelines

  • Cleaning: Gently wipe the surface with a soft dry cloth or a slightly damp cotton cloth. Do not use steel wool, hard brushes, or chemical cleaning agents, as these may damage the glaze.

  • Water Resistance: Although our vases are glaze-sealed and offer certain water resistance, prolonged submersion in water may cause bottom seepage or glaze damage. After each use with fresh flowers, we recommend emptying any remaining water within 24 hours and wiping the interior wall to prevent mineral deposits.

  • Thermal Shock Warning: Ceramics are sensitive to drastic temperature changes. Do not move a piece directly from a very cold environment to a very hot one (or vice versa), nor rinse it with boiling water, or place it in a microwave, oven, or dishwasher—such actions may cause cracking or breakage.

  • Display Safety: Place the piece on a stable surface where it is unlikely to be knocked over, away from table edges, children's play areas, and paths where pets may run. Damage caused by accidental drops is not a product quality issue and cannot be returned or exchanged.

3. User Conduct Obligations

  • You agree to use our website and products solely for lawful and compliant purposes, and you shall not use our content to engage in any activity that violates applicable laws and regulations or infringes upon the rights of third parties.

  • You may not copy, reproduce, modify, distribute, display, perform, publish, or use our website content for any commercial purpose without obtaining our explicit prior written authorization.

  • You undertake that all personal information provided at the time of ordering (including but not limited to name, address, and contact details) is truthful, accurate, and complete. Any losses resulting from inaccurate information shall be borne by you.

IV. Intellectual Property Rights

The brand name Boywithgirl, brand logo, product design drawings, three-dimensional shapes, glaze formulas, product photography, website layout and design, textual content, and related visual materials are all protected under international copyright laws, trademark laws, and unfair competition laws. All ownership and complete rights to the above intellectual property belong to HONGKONG KATE LIMITED and its affiliates.

Without our explicit prior written permission, no individual or organization may:

  • Use our brand name, logo, or product images in any commercial promotions, advertisements, packaging, or sales activities;

  • Reproduce, excerpt, or capture graphic or textual content from our website in any digital or printed form.

We respect the intellectual property rights of others, and we ask that you respect our creative output. We reserve all rights to pursue legal action against any infringement of Boywithgirl's intellectual property.

V. Orders and Contract Formation

1. Nature of Website Information
All product images, textual descriptions, prices, and stock status displayed on our website constitute an Invitation to Offer, rather than a legally binding offer. When you submit an order, your action constitutes an Offer, indicating your willingness to purchase the relevant products under the terms stated in the order.

2. Time of Contract Formation
When we send you an Order Confirmation Email, this merely indicates that we have received your order request and does not signify acceptance of the order. The contract of sale between you and us is formed only when we have actually handed the product over to the carrier and sent you a Shipping Confirmation Email.

3. Pricing and Payment
All prices shown on the website are denominated in USD. We reserve the right to correct prices due to exchange rate fluctuations, changes in raw material costs, or system errors. If a pricing error is discovered after order confirmation, we will contact you promptly to seek your decision—you may choose to proceed with the purchase at the corrected price or cancel the order for a full refund.

VI. Cross-Border Shipping and Customs Clearance

As a handmade brand serving customers worldwide, we offer shipping services to most countries and regions around the globe. All orders are dispatched from our workshop location via international express to your designated shipping address.

1. Shipping Terms
For specific details on processing time, transit time, carrier selection, and shipping rates (global free shipping), please refer to our separate Shipping Policy page, which together with this Service Policy constitutes the complete transactional agreement.

2. Customs Clearance and Duties
You understand and agree that cross-border shipping involves customs clearance procedures in the destination country/region. All import duties, value-added taxes, and other related taxes and fees are the responsibility of the recipient, and we are unable to estimate or pay them on your behalf. If a package is returned, delayed, or destroyed due to the recipient's refusal to pay duties, failure to provide required customs documentation, or inaccurate address information, any related losses and costs shall be borne by the recipient.

VII. Limitation of Liability and Disclaimers

1. "As Is" Provision
Except for the warranty scope explicitly stated in this Service Policy and our Return Policy, our products and website are provided on an "AS IS" and "AS AVAILABLE" basis, without any other express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

2. Limitation of Liability
To the fullest extent permitted by law, neither HONGKONG KATE LIMITED nor Boywithgirl shall be liable for any indirect, incidental, special, or punitive damages arising from the use of our products, website, or services (including but not limited to loss of profits, data loss, goodwill damage, or replacement product procurement costs). Our total liability in any case shall not exceed the amount you paid for the product in question.

3. Force Majeure
We shall not be held liable for any failure or delay in performance caused by events beyond our reasonable control (including but not limited to natural disasters, war, terrorist acts, strikes, lockouts, pandemics, government actions, transportation system disruptions, raw material supply interruptions, etc.). During the continuance of such events, our obligations shall be suspended, and we will make reasonable efforts to mitigate the impact on you.

4. Third-Party Links
Our website may contain links to third-party websites or resources. These links are provided solely for your convenience in accessing additional information and do not imply our endorsement, recommendation, or guarantee of third-party content, products, or services. You access third-party links at your own risk.

VIII. Policy Modification and Termination

1. Policy Updates
We reserve the right to amend this Service Policy from time to time in response to operational needs, changes in laws and regulations, or industry practices. Any revised version shall take effect immediately upon publication on the website. For confirmed orders, the version of the Service Policy in effect at the time of order placement shall apply; for new orders, the most recently published version shall apply. We recommend that you periodically review this page for the latest policy updates.

2. Partial Invalidity
If any provision of this Service Policy is held by a competent court or arbitration body to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

3. Non-Exclusive Relationship
This Service Policy does not create a partnership, joint venture, employment, or agency relationship between you and us. You and we are independent contracting parties.

IX. Entire Agreement

This Service Policy, together with our Shipping Policy and Return Policy, constitutes the complete and exclusive agreement between you and us regarding the use of the Boywithgirl website and the purchase of its products, and supersedes all prior or contemporaneous oral or written communications, proposals, and statements. All rights not expressly granted in this Service Policy are reserved.

We treasure every customer who connects with us through a shared love of handcrafted art. This Service Policy is not merely a list of terms—it is a reflection of our commitment to transparency, sincerity, and accountability. Should you have any questions regarding the above, you are always welcome to reach out to us via our brand's official email address. We will respond with the utmost patience to address every detail of your inquiry.
